[Discussion] Is not mentally competent, affluenza and insanity pleas just a cop out?

I was checking out the ruling over a girl who lured and stabbed her friend in the woods to please "Slenderman" was declared by the judge that she isn't mentally competent to stand trial and understand the nature of her crime. Keep in mind both of the girls are 12 years old(the one who stabbed and the one who was stabbed). Do you think that its right or fair for her to be sentence to rehab instead of prison time? Its almost like the one about the kid who killed four people in a truck while he was intoxicated and he is only 16. His lawyer presented that the kid has Affluenza because he comes from a rich parented background and therefore was not aware of his action and should be dismissed. This kid did not even receive a single day of jail time. Instead only 10 years of probation. He kills four people underage and drunk and only gets 10 years of probation. Another note to add, both of the kids are white. Race seems to play a big part in who seems to get justice either because of their money, race or both. What do you think should have happened to these two criminals or to any criminals for that matter?

Just to throw in another story that happened locally where i live. The sheriff in my county has been in office for over 20 years and a few months ago was arrested for federal money laundering and accepting bribes from drug dealers to allow smuggling to happen under his radar. He was only given a 35,000 bond and only a 5 year jail sentence which he is trying to appeal. The next day, literally the next day a black man steals 2 cans of beer from a convenience store and he returns to pay for the beer later and the police still arrest him. He currently is in jail because of his 20,000 bond and is pending trial.

Sometimes it is sometimes it isn't, I suppose the rich background excuse is kinda BS but yeah, sometimes people are crazy, they should at least have to go to rehab and other things to get them sorted out, if they are indeed crazy that is.

This girl is from a place like 30 minutes from me and i know someone who was in jail with her, apparently you can obviously tell she's just trying to get off. I'm sure her parents visit her and tell her to act as crazy as possible

There are a lot of malingering people trying to avoid jail. I evaluate them all the time. The truth eventually comes out. You can't fake mental illness forever. Eventually they slip up and do something lucid.

Ya but it does not mean that they shouldn't get punished like everyone else does

Affluenza is one of the dumbest things i have ever heard of and couldn't believe it was true even when i read that article

Its ridiculous, "oh i'm 12 years old i almost killed a friend so let me go ok so i don't have to spend 60 years in jail"

There are a lot of malingering people trying to avoid jail. I evaluate them all the time. The truth eventually comes out. You can't fake mental illness forever. Eventually they slip up and do something lucid.
True but they still get away with it through the legal system which is complete bs

It doesn't really matter if they became like that because of their background, they can't live in society and that's it
No it does matter it always matters when it comes to money and the judicial system

Another story to add. A Judge was arrested 2 weeks ago for a DWI. Just right now she was acquitted of her charges. When she was pulled over the officer she said she was a judge and pulled out her badge and when the officer arrested her she said" Please don't do this. You are going to ruin my life"

Not for long, and many of the state hospital for forensic admissions (violent offenders) are worse than jail. I evaluated someone who stabbed their spouse 28 times. They were pretending to be psychotic and doing a pretty good job of it until I saw them step around their fecal matter in their cell. I sent them to the forensic hospital for mentally ill anyway, just to be sure, but within a week the person was discharged back to prison. We're pretty good at spotting fakes.
