That's a completely incorrect statement. He's still standing and still capable of fighting. When he's on the ground, incapable of standing any longer, you can claim he can't use kamui without dying. But now? Nope.

Sasuke isn't even close to Kakashi in tactical intelligence..of course, no one outside of Shikaku and Shikamaru are. Sasuke also lacks any way of hurting Tobi.
