Why would you use Itachi saying he didn't kill Shisui? He's not going to say "Yes police task force who would arrest me or have me put to death, I killed one of the Uchiha's most talented Uchiha who did any mission the clan asked for him".

Shisui was said to have drowned in a river and here in Itachi's memories he's showing Sasuke they're by a flowing water source as Shisui gives Itachi his eye

. I'm very sure Itachi aid Shisui in dying because he told Sasuke to gain the MS you have to kill your best friend and Itachi didn't have the MS before Shisui died.
