If he had all his jutsu, + EMS (for example) then i'd say top 5. Being Orochimaru, he'd be the one to find a way to then progess his sharingan into the Rinnegan, and he would then be top 3.

Well, time to go off on a tangent. I can give you a similar situation that could've happened. Sorry it's not directly relating to the question.

If by some chance Orochimaru obtained Sasuke as his vessel. He could've become nearly unbeatable. So, Orochimaru would have the Sharingan, from there he could maybe get MS (I'm not sure how, this is one of the holes in the theory), then fight Itachi and if he beat him. He could get EMS and Yata Mirror + Totsuka Blade (More plotholes, if he could get those or not). Then from there, assuming the scroll Suigetsu has is a key on to how to get Rinnegan. Then Orochimaru would've been able to get Rinnegan as well.

Because of this, Orochimaru would have Blade of Totsuka, Yata Mirror, Susanoo, Amaterasu, Tsukuyomi, Rinnegan, Snake Techniques, Blade of Kusanagi, Intelligence on nearly everything happening/happened in the narutoverse.

And since Orochimaru has Rinnegan, he could master all five basic nature transformations leading him to be able to accomplish his dream of mastering all jutsu.

Obviously there's a huge amount of flaws in this, although this is Orochimarus full potential.

If he was an Uchiha he would be stronger than he is now but not op. He wouldnt be an evil scientist, wouldnt rely on experiments to make him stronger. Knowing his personality though it would be enough for him to be at EMS, being ruthless and evil.

He would just rely on EMS for his powers.

He would most likely be dead too, by Itachi. Tobi's the only one alive thats an uchiha still remaining
