Thank you for showing logic to people who think Tobi=Obito. However, Tobi did not physically 'give' Nagato the Rinnegan, nor does Nagato have Madara's eyes. Nagato awakened his own Rinnegan during his team's fight with Hanzo, when Yahiko died.

He awakened it when his parents died.
