We know now that Kaguya was the Shinju all along.

Then who in the legend ate the fruit?

I suspect that a princess really did eat the fruit. And this happened to her.

Kaguya was part of the Shinju, not the Shinju itself.

maybe Kaguya ate the fruit which was like a watermelon and she swallowed the seeds which in turn grew in her gut to make her part of the new Shinju

No you guys are twisting it kaguya ate the fruit, sometime later she manipulated the people and ended the war, after she gave birth to sons however her sons started sharing chakra which made her angry so she got upset and used the shinju as the core and it transformed into the juubibwith one single thing in mind to take back all the chakra so she became the core of the shinju not the shinjubitself she was the reason the shinju acted that way (juubi) .

From what I understood ( correct me if I'm wrong) the shinju was a non sentient being that created the fruit. Kaguya ate the fruit and became the goddess of nv. When her sons were born, they inherited chakra. This is where translatitons on mangStream and mangapanda differ. *********** says kaguya took the form of the juubi ( kaguya + shinju ) to get back all chakra and give to her sons. Mangapanda says kaguyas will turned the shinju into the juubi to take back the chakra from her sons. Whichever, her sons then fought the juubi, sealing it's husk in the moon and it's essence in hagoromo.
