Well, we don't know if he had Aoda at the time, and Manda sure as hell wasn't going to listen to him. Let him have Kirin. Lightning is Kakashi's element after all, and Kakashi is extremely cautious, so I doubt he's just going to let him do it.

This would be overkill in favor of Kakashi anyway. An unrestricted Hebi Sasuke wouldn't be able to beat current Kakashi(not counting Orochimaru sprouting out of him..because that's not Sasuke winning at that point, it'd be Orochimaru), much less one restricted to this degree.
