First of all, we do not know what Tobi's abilities are to the full extent and what technique he is using, so there hasnt been enough information so far to give a satisfactory answer, except guesses, so here goes: I think tobi is kagami uchiha, who was in team tobirama and learned and surpassed his master. He is about the same age as sarutobi and danzo, also was present during madara's age, so he could have carried on his legacy.
