What I really need to point out is, that Obito said “I like you, Kakashi”, which either means:
-Kakashi still holds the Bro-Status
or
-Obito is just completely friggin insane.
I get the feeling that he really doesn't have cruel intentions towards everyone else, he honestly believes he…will make a better world for everyone and mentioning that he will make a better world for everyone, makes me believe that he really wants everyone to live this “happy” life just like him (he just could have go around and make the genjutsu only for himself)….buuuut if anyone gets in his way he just straight-up kills them, because he is a total extremist when it comes to his believes. Yeah, he is f*cking insane, he completely lost it. Obito has sense in his madness.
If this would happen in the real world, he wouldn't go to jail, he would go straight to legal psychiatry, because they couldn't convict him guilty the usual way, considering his messed up life and what has become of him.
