Kabuto has to be alive to give the command to Edo Tensei Nagato to perform the Rinne Rebirth Jutsu. If he is dead, their is no coming back.

Misconception about Rinne Rebirth Jutsu: Nagato expanded to much chakra during his battle with Naruto which lead to chakra exhaustion. However, the rules of death after performing the technique did not apply to Nagato because Uzumaki are known for having a strong life force. Obito's usage of the technique (even on a single target, as opposed to Nagato's use on a village's population) brought him to his inevitable death, as Black Zetsu noted. [Wikia] However, Obito was able to survive the drawback of Rinne Rebirth Jutsu and extraction of the Nine Bijuu due to still possessing the Gedo Mazo (Demonic Statue of the Outer Path) which has tremendous life force.

Nope. If someone obliterated Kabuto's body, ain't no coming back unless he's a Edo.

The key here lies in Edo Nagato. Nagato can use his Rinne Rebirth jutsu to bring Kabuto back to life. So the opponent can kill Kabuto over and over again, but until they seal Nagato, Kabuto will just keep getting revived.

No, Hagoromos Kinjutsu can't be used by Edo Tensei Nagato. Matabi said something like, these eyes, which are made up of dirt, are just simple depictions of the real Rinnegan and doesn't have the same power.

Obito has propably even more life force than Nagato, because of his own and Hashiramas DNA, but Rinne Tensei would have killed him.
I guess, the consumption of chakra is based on the given conditions of Rinne Tensei.

Ehhh, I don't think so. But it's not like he needs Rinne Tensei. His Edo Tensei is enough to decimate everyone but 2 people, give or take.

Kabuto has oro cells and karin cells.
So killing him outright is already close to impossible
oro's DNA lets him take psychical attacks and karins DNA heals wounds automatically

Do you realise that now kabuto has Suigetsu's body so physical attacks don't work on him

Thats clearly false as kabuto was planning on temporarily killing naruto and bee and reviving them later

Doesn't human Path take the soul of the user? If so, that's probably the only exception for Nagato to revive someone, by already having their soul and body next to each other. But if Kabuto just died somehow, Nagato wouldn't have his soul. From the way Kabuto stated in the middle panel, he'd need to soul and body of the person he was trying to revive, and I don't think he can do that unless he killed the person himself. That's what I got from this scan.

human path rips out the soul from the body killing the person, you cant exactly store the soul, it will go back to the pure world as after life is referred to in NV

shizune was killed by human path and was revived along with all the others killed through various means

He brought up a good point.

@Kami sama -

Konan said "if he uses it now at his current chakra levels..." implying that if he hadn't just solo'd a village + massive shinra tensei + massive chibaku tensei, he would have survived after using Rinne Tensei. Obito would have died as well due to chakra exhaustion, but that's just speculation on my part. And about the "dead people can't revive dead people" - Konan says "they say he is outside life and death"

Yet people underestimate Nagato and how much chakra he used in that fight

That would be significantly more powerful if the edo-rinnegan user were far away in Kabuto's hideout and had a strong sensor type that could tell him that Kabuto is dead. Since the person wouldn't be able to reach the edo rinnegan, he wouldn't be able to stop kabuto from being revived.
