In his battle against Gaara, he had it made it previous to the fight. Though in his fight against Sasuke where he hadn't made it beforehand, he didn't even attempt to use it.​

Wasn't as impressive as it looked in the anime. Plus he couldn't escape - hence why his clone blew itself up.
