We know that Danzou has declared Sasuke a missing-nin, for which the penalty is death (recall way back at the beginning Zabuza). We also know that Tsunade chose the opposite path from this week's manga due to a promise.
We have some possible insight from the way the third Hokage dealt with a situation somewhat similar to this (emphasis on the somewhat). Recall that after a war with the Rock country/village (I believe, correct me), a shinobi tried to kidnap Hinata to learn the secrets of the Byakuugan. Her father killed this man. The Rock country/village threatened to continue the war unless they deliver Hinata's dead father to them. To avoid war, Neji's father (Identical twin of Hinata's father) was killed and delivered (presumably after the seal was used and his Byakuugan destroyed.
Now Danzou's action of declaring Sasuke a missing-nin could avoid a war. Granted he has other reasons for doing so that are stronger but not publicly known (Uchiha slaughter and Nagato).
Finally, Kakashi did essentially say that it would be standard practice to declare Sasuke a missing-nin. I wonder how the first, second, third, and fourth Hokages would've handled the situation.
