What Itachi sealed was Orochimaru's chakra (or piece of his soul) that was in Sasuke's CM. Not Orochimaru himself, or his original soul/chakra.

That is the explanation. The Oro that Sasuke took out of Anko was never sealed in the gourd in the first place, so there was no "escaping". There is no contradiction with the databook statements about it's abilities whatsoever.
