He most likely got it from Hiruzen, like how Orochimaru got the Kusanagi from Hiruzen. The Kusanagi, Totsuka, and Yata are all equally legendary weapons in the Narutoverse.

How da hell would hiruzen intrust it to itachi? The only way i see that is if to summon the yata mirror you needed a scroll which hiruzen had, but i doubt it.

Itachi's blade and shield are spirit weapons and they chose who wields them. Itachi was te chosen one. Both of the weapons are explained in mythology. Read up on them. That's why with the vast knowledge Orochimaru has, he was never able to figure out where they were.
