Who knows, maybe Indra did have Rinnegan or maybe not, it is unknown. It is just confirmed that he has M-Sharingan. Interesting would be to know, did he lose eye sight by using MS? There is no possible way for him to get EMS, as he is supposedly first to use Sharingan.

He inherited his fathers strong chakra and powerful spiritual energy. While Ashura worked hard to gain the "bodily chakra" aka physical energy along with rikudou sagemode allowing him to use senjutustu techniques/gudodamas while manifesting powerful physical energy known as the yellow cloak.
Not everyone with rikudou chakra gets the rinnegan even kakashi was given rikudou chakra from Obito and he didn't awaken the rinnegan, remember that Ashura and Indra are blood brothers after all. They just have different types of energy.

He has hagormoo's chakra because he naturally inherited it. It's really that simple. He shares the same blood as his brother, so getting his dna is completely useless. And I hope you know that Indra's incarnates need hagormoo's chakra to awaken the rinnegan, not Indra himself. And if you carefully read the manga. Madara and Sasuke were the only incarnates with hagormoo chakra to awaken the rinnegan. There have been many incarnates that Black zetsu mixed to get Hagromoo's chakra yet they never awakened the rinnegan.

Gaining Hagormoo's chakra does not mean you automatically awaken the rinnegan. You can have hagormoo's chakra without awakening the rinneagn.
Mixing ashura's chakra with indra's chakra is just another way of gaining hagormoo's chakra. Hagormoo's chakra is what gives few people the rinnegan whether you mix his son's chakra or not.
