First picture happened because Hiruzen didn't have the heart to kill his own student. Second picture happened because Orochimaru waited until Hiruzen was 69 years old to attack him. 59 year old Hiruzen would have killed Orochimaru if he wanted to.

I have re-read it. Orochimaru would have been killed. 2 jutsu was only used because every other jutsu of his is weak against Hiruzen.
