Superman and batman are icons and joker and lex being the iconic villians joker has been killed before in some of the darker batmans can remember the edition lex luther has been also been sentence to life imprisonment as a president during public enemys

Human behavior can't be standardized that easy
There are different motivations consequences etc. Smh
You cant kill maniac/no super power villains although they have kill many innocent people directly/indirectly but you must kill the villain with power that can destroy the planet/galaxy/universe bcus they are to dangerous and they will do so. And go out as a hero,

Logic of most people I think that support "It makes you no better than him"

It's smarter to create solid villain characters that can still be used later on. Having to keep coming up with new ones because all the others were killed off will only lead to bad and forced ideas.

It's just there so mainly the writers don't have to come up with new villains to use in stories. Though this most of the time this is a DC Comics problem than all of comics problem than it is suggested as. That said the rule has benefits but also its downsides main example of this as you said is Joker.
