Has Kabuto surpassed Orochimaru?

Hmm, I don't know about that. I wanna say he can, but I really don't see how Kabuto is going toe to toe with a Four-Tails Naruto and winning. Regenerative abilities are helpful, but not enough, and I think Manda II as big as it is would still get wrecked. Orochimaru was able to fight Naruto because of his wide array of jutsus, something Kabuto hasn't really shown to posses. I'm sure Kabuto has a lot more to show us, but without knowing exactly what he's capable of it's hard to tell.

He doesnt have those gates
He only has Orochimarus sanke related moves

The Rashomon Gates, Body shedding, Gathering of Snakes, Sword of Kusanagi, Ten Thousand Snakes Wave, and a couple of other things I don't feel like digging up. Also, though they fell the Rashomon Gates were a key component in that fight, Kabuto has no counter/defense for that wicked TBB. But like you said most of them were snake related, whether or not Kabuto can do ALL of those jutsus is unknown. It's not only the jutsus though, the way Oro uses his techniques and puts them together are on another level. But that's just me, I think that Orochimaru has better battle prowess overall.

Orochimaru didnt need manda for 4tails.
And hint hint on the yes part but kabutos taijutsu isn't as good as oro until we see kabuto fight

Yes, but to star off his DNA, he needed Orochimarus DNA to become like him. But Kabuto has supposed Orchimaru for now.
