no orochimaru only layed dormant within sasuke's cursemark.. and sasuke had to use chakra to hold him back... in his fight with itachi that chakra was used and orochimaru came forth and ended up being sealed by itachi using the totsuka blade.... not that it mattered anyways he just came back :|
