It's not obito, but could be some1 from Kakashi's past.. Obito was too young when the nine tails attacked the hidden leaf and therefore doesnt realy fit the character played by tobi (experience, fought minato, kyuubi control etc..)

I dont think tobi is a uchiha though, his sharingan is always activated (like kakashi's) which leads u to believe it is implanted.
