First time felony punishments

What's up guys, idk if anyone here is familiar with the law, or goes to law school or w.e but my little brother got hit with a felony charge on burglary. It's his first offense and the items were returned undamaged. Unfortunately he just turned 18 before it happened so he's an adult by law, I was wondering if anyone on here can give me any insight as to what he's looking at(Can't afford a private attorney) We live in New York.

My guess, he's looking at legal issues. Of some kind. The scary kind.

was there any itimidation on his part? was there other people involved who feared for the life and what not when he was stealing whatever it was? because if there wasnt anything like that, i think a sincere apology(depending on what he tried to take) and humbleness will go a long way, and he might just end up with probation and what not but im no lawyer. all i know is not many people wanna fill or prison cells up with people who arent even violent

He was with two friends. He claims otherwise but I'm more than sure it was peer pressure. And no there weren't any people fearing for their lives, he saw a bike on private property and took it, I'd give you more details on the case but I think that has the chance of incriminating him.

Well I don't know exactly how much time but I can share my experience.

One of my best friends a few years ago with another friend broke into this persons apartment. But the guy who lived there was home and had a shotgun, so they ended up having to wait till the cops showed up. The guy my friend did it with wasn't a citizen and got deported to Mexico. And my friend ended up doing jail time, I think it was like 9 months since it was his first time and he also did work in jail to shorten his time there.

But he was charged with Breaking and entering an inhabitant or something. He's been out but he's been on probation for whats seems like forever and can't leave the city.

he should be fine, unless theyre looking to make an example, i highgly doubt jail time, your prob looking at commuinty service and probation

My sister's ex boyfriend was charged with burglary. He got off with a few months in jail plus probation. It was his first offense too.

It really depends on the prosecutor. They might offer a good plea bargain.

They jail/prison is going through a reform. More likely they are going to let him off easy considering he return the item back undamaged and its his first offense.

Also, he just have to convince the court he made a stupid decision and take full responsibility.

I think he'll get six months in prison depending on the gravity of the burglary felony

Go be a troll somewhere else. That wasn't my point. I'm worried that my kid brother might get sent to jail. If he was a year younger he wouldn't have. I'm aware what he did was stupid, and he shouldn't have done it at any age.

It's likely he'll take a plea for a lesser charge. That is unless there's a mandatory minimum. Id have to look at the specific laws for New York, though.

I'm sorry to hear about your friend. My brother didn't break and enter though. It was an open space. But it was private property so it was classified as burglary.

As in he wouldn't be going to jail for it.......

You still go to juvenile detention centers if you're under 18 and if the time is long enough on the day you turn 18 you go on to jail.

But minors usually don't get charged that badly unless it's a multiple offense. Compared to if your over 18 that's jail time now matter what.
