Don't think that's how genetics work. Or the process of tranmigration for that matter. After all, I'm pretty sure Madara was alive when Itachi was born, so he was still holder of Indra's chakra at that point.

Madara died when Obito was still a teenager, Itachi wasn't born until more than a decade later. It's not a stretch to assume the brother of a transmigrant has a jutsu that belonged to Indra because siblings share common genes.
