Juugo merged his curse mark with Sasuke's chakra which was already able to accept the curse mark... When Sasuke was de-chested, Juugo gave him his chakra. It doesn't mean Sasuke can use his curse mark, which is still sealed, he just has the chakra in him now.

The mark comes from Juugo, not Sasuke releasing it. Sasuke's chakra is merely acting as a barrier, and the senjutsu clings to it because Sasuke was able to adapt to it from the start.
