The 2nd branch hyuga aren't pure blood and they're considered hyuga. He is a product of a Hyuga and Uzumaki breeding. What are you talking about?

The Hyuga were never known for their power, only their eyes and bloodline. They aren't humans.

The child would obviously be OP right, probably be able to genetically awaken Rinnegan. But would that breed be contributing to the Uchiha's legacy?

It's an Uzumaki, one whose ties are connected with the Senju and that gives potential to great enhancements, genetically speaking.
As it is, he's already awakening an eye that no Hyuga on their own could, so that alone establishes him as not of the Hyuga but of the both the clan's amalgamation, so I would say in family terms he is, but going as far as his genetics, he isn't the Hyuga's.
He's a branch out in simple words, and an even further one considering the clan with which his blood is mixed is genetically potent. His whiskers speak for this.
