Basically, do you think the fact that Itachi was the elder brother played a big role in his decision to spare Sasuke?

Well, the entire dynamic would be different if Sasuke were the older brother and Itachi was the younger one.

For instance, since Sasuke would be older, he'd be the one trusted with all of Itachi's duties. The eldest is the one who becomes head of the clan.

The question should really be: Would Sasuke spare Itachi if he were in that situation?

It would be less probable, because when you have a younger sibling (provided you get along well enough of course), you develop a parental-like instinct towards them, but not the other way around.

This is a tough one. I mean Itachi already proved to us that he doesn't respect his elders, given the way he viciously and brutally attacked the 3 police force members for no reason. Thus, we can come to the conclusion that Itachi would probably have treated Sasuke worse. This means getting brutally tortured for a longer period of time, possibly getting killed etc. Lol
