Relatives that are closest to each other must both have MS to fuse into one EMS. Two pairs must be require, hence Madara cannot have EMS since he only has one eye. Plus, Obito is more distant from Madara

It doesn't necessarily have to be a brothers eye, but the tighter the blood ties between the "donor" and the receiver, the better it is for compatibility. So it it's your brothers eye than yes the changes of gaining EMS a better, but Madara already had EMS, so why would he gain it again?
