They were. When your soul has no root in the physical plane you are dead. Orochimaru is like a ghost at best.

The difference is that he retains consciousness in his chakra AND is able to recreate his WHOLE body from scratch with chakra only.

Lol he left with 0 damage, while Tsunade turned into an old hag that couldn't even take a proper breath and Jiraya was left with broken leg and ribs.

Jiraya should've been thankful that Orochimaru didn't kill him while he bit him.

Exactly, he could have killed them, but Tsunade's punch did some serious damage to his head. A few SECONDS earlier he was about to KILL both Tsunade and Jiraiya, so my point is still valid, Tsunade forced him to retreat.

Oral Rebirth would still work. The NV isn't the real-world and Orochimaru is not at all an ordinary man. The decapitation argument is a desperate, incorrect one and should never be used again.
