At that point in time I believe he had just been revived after being assasinated byt the Red Skull. You see when Norman Osbourn was put in charge of the Avengers program he hired different villains to pretend to be the original members so that the public eye would be fooled. He couldnt find a villain with same skills as Captain America so he combined Iron Man and Captain America ideas together I made the Iron Patriot armour.
