Critical questions about Kurama and Tobirama

Hi guys, this is my first thread in narutobase so pleaz don't flame me =D
in this chapter

we saw that everything sealed inside the stomach of the shinigami was freed from the seal, even Oro's arms, except one thing witch is the other half of Kurama. some guys say that it still sealed inside minato but if that was true then the second and the first hokages would be inside the third hokage but that wasn't the case. does that means that it will return to Kurama at the next biju mode transformation ? i bet that we will see another form of the biju mode for naruto. some others say that Oro has control over the shinigami so that the other half of Kurama won't break free but i personally don't think he is strong enough to do that.
finally i have one question: we all know that the second was the one who devised edo tensei jutsu so he surely know its weakness, so why didn't he use the seal of the jutsu to free himself from Oro's control like madara did ?
so what do you think guys ?
