Since the rinnegan is the next level after the sharingan. does that mean regular rinnegan automatically has sharingan based genjutsu within? or do you have to upgrade from EMS to rinnegan to use sharingan genjutsu?

Yah, you can but it's sort of pointless. Why use base genjutsu when you have other awesome abilities like force manipulation, chakra absorbing techniques, meteor spam, limbo etc.

Yes you can, Kaguya even used Infinite Tsukiyomi with the Rinnegan. Madara also continued to use Sharingan jutsus with the Rinnegan activated. Nagato apparently had no idea how to use Sharingan abilities or Madara's EMS jutsus, apparently.

if it's an MS tech, yes. If it's the standard Sharingan genjutsu, then most likely not.
