If BZ was always kaguya's will, then the rinnegan madara got on his deathbed could have been corrupted, or perhaps given by kaguya.

Orr she just took over BZ after madara absorbed the god tree.

When Madara created BZ he was attached to the Gedo. Gedo is the shell of the Shinju. Kaguya is in the Shinju.

Makes sense to me

There 2 possibilities on this:

1). Kaguya was inside Gedo Mazo and Madara was connected to Gedo Mazo. So, when Madara created Black Zetsu, this influenced Kaguya upon the Jutsu.

2). When Madara absorbed the God Tree, Kaguya used her will on Black Zetsu.

Choice 2 is probably closer, since Kaguya's presence started to take effect from the God Tree.​
