Did NB ever legalize gay marriages?

Or you could have it like where I live
Gay marriage's, Abortions and the like are neither illegal or legal.(this mean's they can still happen and stuff, but there aren't any law's on it). And it will probably stay like that because

1) It's politically incorrect and any mention of it in the house of common's would be political suicide.

2) The Charter of Rights and Freedoms Gives A LOT of power to the Judiciary court who if they believe that any new laws impedes on the right's of anyone, they can wave the charter around and pretty much make that new law void.
