Technically it was never specified that he had the 9 tails and given the trouble the Sage went to to break up the ten tails, it seems odd to just stuck a tailed beast back into a seal, this time on his son. I think he just had a chakra avatar, not a tailed beast. He likely had Six paths senjutsu and possibly another form of senjutsu.
