As we all know, Aokiji is currently a vagabond. He is no longer a marine, nor exactly confirmed a pirate either.

All we know till now is this,

He came to Punk Hazard to meet with smoker. But before that, doflamingo made a strange comment about him,

And we have this conversation happening right after between smoker and Aokiji,

The second page is quite interesting but we will talk about the first page first. Kuzan explains how not being a marine give him an objective view of the scene.
Now, on the second page Smoker directly asks Kuzan if he worked with the underground community and Kuzan neither accepted nor denied the fact but in his own way told smoker that he was not doing anything wrong.

This image is also rather interesting, he left a complete cryptic warning about the true state of dressrossa. He basically told smoker, that Doflamingo was not the true king of dressross like Boa Hancock. And advised him to tell Akainu to dispatch a admiral.

Next thing we know, Akainu does send Fujitora to dressrossa.
Immediately afterwards we get this little convo between teach and Burgess, about Aokiji saying it's the same as shiliew. That may be in the way that both were ex-marines. But does not make it clear if Aokiji has joined a pirate crew or is working in the underworld.

Now all these things apart we make a fast forward to where Akainu is talking with the Gorosei. There seems to be a rift building there. Now as we know from the war of the best, that akainu does not care if he has to kill marines, or innocents if he gets to kill a few pirates in the crossfire. But I don't think the fact that he was pitted against a fellow marine went down very well with him. So he let Aokiji live, but it was not without a condition.

I think they formed a contract where Aokiji would be serving as an intelligence agent who would be reporting not to the world government but Akainu alone. And since he can't be seen keeping in touch with the marine fleet admiral all the time he chose a innocent medium like smoker to pass the news on.

Basically, I think Aokiji is a double agent working and supplying information to akainu.

It wouldnt surprise me much if he was. I find it hard to believe kuzan would report directly to akainu after losing to him, their ideology is too different and for that reason I think that if aokiji is reporting to him, then their fight must not have been an ideological one and was instead a rouse to allow aokiji to slip into the underworld with less suspicion.

But again, I think their ideology is too different, if anything, aokiji might be reporting to kong instead and is bypassing akainu and perhaps even the celestial dragons. He certainly has his own goals in mind, but it might be as simple as setting up the stage to prevent the world government from repeating the war from 800 years ago without any espionage factor involved. Most likely though I think he will be used to further the plot for the strawhats at least indirectly, if not intentionally.

Isnt he with black beard now. I think you find out in derossa not certain. I think hes there to watch him not join him but i cant wait for him to come back ive always liked him and his layed back demeanor

Hmm, that's nice what you're thinking there...

Aokiji being a rather rational person just doesn't fit to become a pirate from absolutely opposite marines, he's definitely there for mysterious purposes and also BB trusting him completely would be illogical because coward and a douchebag though, he ain't a dumb person. IMO he's made to this point relying mostly on his malicious wits...

When Caesar telecast shinokuni in underground world that's where aokiji saw smoker and thought it could be dangerous for him. Aokiji is with BB, working currently in underground but still cares about his friends. He is no double agent, until plot wanted to.

I was thinking the exact same way.
He did say that there is more than one way to help without being in the marines.
