No, Uchiha Madara was summoned by Kuchiyose: Edo Tensei. But, unlike the 1st, 2nd, 3rd or 4th hokages, Nagato etc. his soul isn't actually sealed away. It is merely unsummoned due to the ending of Edo Tensei.

In other words, Madara's soul isn't bound up.

Can Tobi reincarnate Madara using Gedō: Rinne Tensei no Jutsu?
There is nothing right now to suggest that he cannot, unless Kishimoto decides otherwise.

If people are correct on Nagato's eyes being transplanted, then Madara would be revived without his eyes and that would be useless. I don't see why you'd bother reviving him.

I suppose he can, but then he'd have to settle with a regular Sharingan like Tobi and he has no S/T techs like Tobi (further implying they aren't the same people by the way) so he would have half of the power of the Rinnegan, no access to his MS jutsus especially his favorite, Susano'o, which would mean he'd be stuck settling for jutsus he hardly has any knowledge of and... I think you're getting the point.

Can Madara regain EMS?

Tobi has a huge stock of Sharingan eyes.

When a user who has achieved Mangekyou Sharingan gets ANY sharingan transplant, he automatically gets EMS, provided the body accepts the eye as compatible.

To clarify,
the first pair of eyes that Madara had = Mangekyou Sharingan.
the second pair = Eternal Mangekyou.
If he gets another pair that will also become EMS.

In fact, he can evolve both these eyes to Rinnegan mode again.

So why is a siblings eye preferred?
The tighter the blood ties are between the "donor" and the receiver, the better it is for compatibility — a sibling for example would make the best donor.

Madara can't be revived by it for the simple fact that it needs the body to send the soul to. His body should be deteriorated by now. Unless tobi truly is a "shell of madara", it won't work.

Good point, but remember what Tobi said? That he wanted Nagato to save his Gedo Rinne Tensei for him? So, it is likely that Tobi is either the shell of Madara, or that he has the body preserved.
