Itachi told Sasuke not to kill Kabuto, that's why he did use Amaterasu to attack...in other case Kabuto would have problems with black fire=D

Sasuke ignored Itachi and kept tried to stab, slice, and burn Kabuto; he even used Amaterasu.

Kabuto was just too fast and has sage sensing, on top of that he can just spit out new bodies.
