I don't personally hate him but I think he is very much disliked because in the face of overwhelming evidence that he is doing the wrong thing, he continues to make the obvious wrong choice.

As far as rank goes, he didn't even legitimately get the gennin rank. He basically has no official rank. He is comparable to a few higher ninja ranks but holds no rank.

Kakashi's eye is an implant from somebody else. You don't lose eyesight upon taking someone else's eye. This was first told to Sasuke by Tobi. Kakashi basically has the eternal Sharigan and will never lose eyesight.

We are not even sure if Tobi is actually Uchiha yet. It's possible he is from a different lineage.

Sadly for him, he is immortal. His body was blown to bits and he is pretty much a talking head. If he does come back it will be as a joke. He would make a good mantle piece now or maybe mounted at the door to ward off trolls.
