well...we know that itachi actually is or was a good guy, and we hate to fight.... and he still love the village and jiraiya was a konoha ninja, so he don't kill him. and jiraiya and oro was bestfriend before, so maybe ero-sen have (bestfriend) feelings for oro, so he couldn't really fight...
