it has to be an ems to get rinnegan because you have to have yin chakra on par of the elder son's or obito and danzo's ms would have changed into a rinnegan
shisui's kotoamatsukami uses so much yin chakra since it is a genjutsu that it would usually take 10 years to be able to be used again, unless you have hashi's yang chakra or physical energy to counter it

Good theory. And it makes sense that the eye that the Uchiha ancestor received was the EMS, although I believe that the immediate down grade had to do with the Juubi..

The way I see it now is that the Juubi passed down some of it's properties into the Sages son. And that was why the two got different things. As the Juubi was passing down some of it's treats the sage wasn't able to pass down a complete unaltered genetic information.

That would also explain why there are tomoes in the Sharingan just like in the Juubi's eye.

i don't know what to think of the uzumaki
but about the hyuga when the elder son's eyes yin chakra was thinning somehow the ancestor of the hyuga clan was getting more yang chakra which resulted in the byakugan
yin+eyes=sharingan and yang+eyes=byakugan
hyuga means toward the sun(symbolizes yang) uchiha have the power of darkness and the moon eye plan(yin)
and that's how the uchiha's clan origins lie within the hyugan but that's another theory
