I believe Sasuke used the curse marks chakra, if this is obvious to some people then that's cool xd I just see a lot of people get it wrong. I might be wrong actually

This may be true, but first we have to know exactly how the curse mark works. I mean does it have its own chakra reserves which are added to Sasukes(I personally dont think so) or is it merely a physical stimulant which powers up his body and chakra type. Also Sasuke was shown many times using the powers of the curse mark during their battle, so unlike when he first got it and needed to exhaust his original chakra, since he was restraining its power with his own, to use the cursemark he could then control it freely whenever he chose to. Another thing is simply because Deidara says Sasuke is out of chakra at the point which you showed does'nt make it so, he has no way of measuring Sasukes chakra or reading how much he has left. If you recall when Sasuke was truly out of chakra reserves in his fight with Itachi Orochimaru was able to free himself but with Deidara that was not the case.

The curse mark is Orochimaru's senjutsu chakra (juugo's) infused into the carrier of the curse mark. It absorbs the users chakra but in turn granting senjutsu enhancements. This forcefully accesses itself when Sasuke is in need of chakra (as seen in part 1) or if the user has obtained the second state, at will.

As for the Deidara not knowing stuff. It's Naruto man, ninja can observe based on what they see and most of the time their theory's are correct. Sasuke also never responded in disagreement, I believe he was out of chakra.
