Jiraiya dead or not?

Why didn't Kabuto use Edo on Jiraiya? He used it on Asuma and other shinobi from Konoha? Why not Jiraiya he is one of legendary sannin or maybe Jiraiya is not dead. Remember what Gaara sad to Naruto about the real Madara. They have to be dead to be brought back to this word with Edo. So why not Jiraiya is he still alive?

2) Jiraiya is dead. He's lying at the bottom of a lake. If the wounds didn't kill him, the pressure of the water and the drowning process made sure of that.
Kabuto can't Edo Tensei someone whom he hasn't DNA of. He didn't manage to get DNA of Jiraiya so he didn't Edo Tensei him. Plus he brought back the shinobi that would bring a lot of problems for the others. Jiraiya may be strong but he isn't up to the levels of Madara and Nagato for example. To be really strong he needs Pa and Ma and they aren't willing to help a corpse.
