When will Tobi have the upper hand?

Will Tobi get the upper hand now? Or will Kishi save it till he becomes the Juubi jinchuuriki?

He haven't had the upper hand since chapter 564 to 570. If he had the upper hand then he would obviously use the Rinnegan's power.

killer is already paralyse and kakashi is down by overusing kamui. only gai and naruto are in action now.Gai will probably protect kakashi and eventually fight the juubi with 8 gate.Killerbee is already capture technically because naruto cannot remove the rods that seal tailbeast chakra because he will get seal also.
