Beats me, all I can tell you is that they can be unlocked by anyone (who's capable of doing so) with Sharingan. I'm surprised Itachi never did. Sasuke might. Shizu probably could have.

Oh yes, but they'd have to come from Sharingan first. We know now that the Rinnegan came to Madara because they were unlocked. I doubt he's going to steal Tobi's, or Madara's.
