Notice how itachi was already fatigued from using tskuyomi twice and amaterasu once along with a genjutsu against kurenai. Also kakashi only got trapped because he had his eyes focused on itachi. Your trying to win an argument without considering the facts against, and the fact is itachi stated it was a stalemate.
