Thread title says it all.
THEORY: Tobi has the Mangekyou Sharigan
PROOF: ITACHI said so... "3 people with MS" (not Sharigan)
Manga 385, page 2
On page 2, after the Uchiha Slaughter, Itachi told Sasuke: "If you can awaken the Mangekyou Sharigan, then there will be THREE PEOPLE who can use it, including myself". Which means someone ALIVE other than Itachi has the MS. If he meant dead OR alive, he would have said more than 3 people. Izuna/Shisui OBVIOUSLY had the MS as well, FYI.
Sasuke describes this 3rd person with the MS as the "Third Uchiha Survivor". Take note that this 3rd person will be an UCHIHA, Itachi later clarifies.
SUPPORTING EVIDENCE: The 3rd person is not Izuna, Kakashi, Danzo or Shisui, the only other known MS Users.
ASSUMPTION: Itachi thinks "Tobi" is Uchiha Madara before his death
In the link above, Itachi says that he was referring to Uchiha Madara, the first person ever to awaken the Mangekyou Sharigan. THIS IS THE PERSON HE SAYS HE DID THE UCHIHA MASSACRE WITH. He does NOT call him "Tobi"... but obviously thinks they are the same person(read on). Again, this is the shinobi he tells Sasuke he completed the Uchiha Massacre with.
1. Immediately after the Uchiha Massacre, Itachi joins "Tobi's" group Akatuski to keep an eye on "him" from the inside. He obviously does not view Madara and Tobi as two different people at this moment.
Note: For people that think Itachi did the Massacre with Madara and not "Tobi" remember these points:
2. Itachi NEVER claims to have worked with BOTH Tobi and Madara, only Madara.
3. Tobi has the wall of Uchiha eyes from the Massacre.
4. Itachi afterwards went to work for "Tobi" FOR SURE in Akatsuki. He says he did this to keep a further eye on MADARA from the "inside". If he viewed Tobi/Madara as different people Itachi would have realized this after joining Tobi's group.
5. Madara was revived with Edo Tensei, and was shocked. This proves that he was DEAD (soul in Pure World) at the time of the Edo summoning, that he died "young" (he has a "young" Edo) and that he had never been previously revived with Edo Tensei. Also, Nagato did NOT revive Madara with his Rinnegan either, which would mean only TOBI was alive during the Uchiha Massacre, not MADARA.

People STILL are misunderstanding this statement, so let me break it down:
1. Itachi ("Including Myself")
2. Sasuke ("If YOU can awaken the MS")
3. Madara (Itachi says this 3rd person is Madara Uchiha)
If he meant dead OR alive, he would have said more than 3 people. Izuna AND Shisui OBVIOUSLY had the MS as well, FYI. This would make 5 people that Itachi knows with the MS "INCLUDING MYSELF"....
1. Madara (Itachi say so)
2. Izuna (Madara has EMS)
3. Shisui (Itachi took Shisui MS before the massacre)
4. Danzo (Itachi knew he took the other one)
5. Itachi (HE SAID "INCLUDING MYSELF")

Just because Tobi has never showed his MS, doesn't automatically mean he doesn't have one. And just because he has never deactivated his sharigan doesn't mean he isn't an Uchiha. These are both ASSumptions.
