Detained For Open Carry of a Firearm.
"I was detained by Portland PD officer J McDonald on 26MAY2012. He detains me without suspicion of any criminal activity in violation of Delaware v Prouse. He admits his sole reason for stopping me is my legally carried firearm in violation of US v DeBerry. He seizes my weapon with no reasonable suspicion that I've committed a crime in violation of Terry v Ohio. He demands my ID without reasonable suspicion in violation of Hiibel v Nevada"

Thoughts?

Yeah, it's BS. I come from a pretty gun friendly area of the US. People wield firearms in public all the time, so I'm used to it. It's when people have concealed weapons (illegally) that I have a problem.

I don't own a firearm, and I know if i saw a guy walking down the street with a gun i'd turn the other.

Nonetheless.

I'm just amazed by how much this guy knows about the law and how he got the officer let him go with his weapon, because this situation could have gone seriously wrong...

Eh, like I said I come from a very gun friendly place. As long as you're not at a school or something like that and you aren't menacing anyone, you can carry a gun. It's not a big deal.

IDK, its certain laws in different states that says your not to have an open carrier containing a firearm. The carrier must be closed. Its important to understand the main law which protect your rights and additional laws protaining firearms, but I think the police officer was in the right, to some extent.

I'm not to fimilar with the firearm laws and courts.

Edited: Misread <LOL> -FacePalm- Back to where I was saying, its laws and certain states that prevent you from carry illege firearm.

Of-course to some extent the police officer was right, it is highly unsafe to just let random people walk around with a gun out in public view and as a police officer it is your job to keep the public safe.

In all states in the US it is legal to carry an unconcealed firearm. Just carrying a gun is not reasonable suspicion and does not grant a police officer the right to stop and arrest you.

Incorrect. Unless the man was menacing someone, he is acting within his given rights. The officer was in the wrong.

Don't you think that law is a bit bitter-sweet?Not trying to be fascist or anything but without knowing who is supposed to have an open carry and who isn't, doesn't that potentially put the public at harm?

Yeah! Your right, but when does the police do random searchers. I have met many who have illege carry of a weapons, some not, but the police never came and did some search, seeable or not.

Curse the weapons of today. Guns and bombs should be replaced by swords and shields like in the old times. Samurais used to always have a katana in their possession. Its because of AK-47s, M16s and other guns as well as bombs why the world today is corrupted. People are easily able to misuse them and cause destruction to places that be peaceful and prosperous. It is one of the main reasons though, no doubt.

Well, to be honest, I'm not sure why people want to carry guns. Of course, I live in a place with a really great police force (which I recently found out not everyone has :( ); so my standing is I just let the officers carry my gun for me.

Around here, people who carry guns are kinda' considered cowboys (and not in a good way). They're always out of control and have some power hungry agenda, they also like to stand up for their right to bear arms and make a big stink about it. It's annoying, and they're really scary. Don't get me wrong, I believe people should have the right to carry a gun; I just don't like guns, too many chances for an accident.

Like Chris Rock said, though: "Don't go to parties with metal detectors. Sure it feels safe inside, but what about all those cats waitin' outside with guns? They know you ain't got one."

In other words, as long as people don't know whether or not you're armed, then everything's okay. The moment that guns are outlawed, then regular people will be in trouble. Crooks can always get a gun, and they'll know you don't have one.

I think we should all just go back to the Fisticuffs days.

The power of a weapon is just too great for some people...

Haha love the Chris Rock quote btw

Well said. :D
It takes much more skill to use a sword than to pull a trigger or push a button.

man, I seriously think a change should take place. Because to be honest, anyone can use a gun including a scrawny ****** and an old granny xd If they brought back and used the swords and shields. The skill and experience of the person would determine whether they will win the fight or lose. Its much more fair. If I was in a war(not that I like wars), I would prefer using any of the following: katana, odachi, nodachi, wakizashi, yari and tachi. Man, I would definately need to practice kenjutsu :D

Well, for one thing, there wouldn't be any deadly accidents. A sword doesn't just accidently fire; you can cut yourself alright, but killing yourself or another person is more deliberate. People would still murder the innocent and defenseless though, that wouldn't change, but might drop overall due to the close combat (potential murderers might think twice about being stained with blood splatter ;) ).

The main problem though is that people are cowards. I seriously doubt that everyone would simply throw out the guns and only use a sword...there'd be plenty that still had firearms.

Sorry i don't understand what your trying to say. Do you agree with me or not? More bloodshed is actually caused by guns rather than swords. Besides, sword attacks can be dodged or blocked, bullets can't be blocked or dodged unless someones wearing a bulletproof vest but not everyone wears that and the vest will only protect your body. One gunshot in the head and its all over for you.

I do agree with you here though, majority people of the world are cowards and just think about getting the job done no matter what and at any cost. They aren't rational and don't think about what the outcome will be, unfortunately. The world is becoming an evil place and will continue to if no one does anything about it. So long as there are good people left in the world, this process of corruption is being delayed. The good people need to unite and rise against the evil. Remeber, good will prevail. Evil will lose. May God help us all. Peace and love to everyone.
