well that's my theory:
to fight the juubi who is a total beast the so6p needed a godly power so he intended in using the rinnegan paths but his body was still weak compared to the juubi's one and he still can't use the rinnegan abilitys to their fullest potential so using his strong chakra and his creation of all things he created the susano'o a perfect body then he put all his paths ability into it and used it in the fight
after the victory the so6p sealed the susano'o into his eyes
the truth is that his son wasn't born with the eyes but it's the seal that was passed to him and that's why his eyes aren't similar to the other sharingans
anyway when the seal was devised to the entire clan he changed his apparence and was called sharingan
ONLY the ones that upgrade their sharingans are able to summon the legendary body but he hadn't the power of the paths and that's the current susano'o
anyway when an utchiha pocesses the DNA of a senju he has the true body of the so6p ( the body and the eyes) so the rinnegan is unlocked
the reason why the rinnegan is the only able to fully read the secret writing ( that madara was speaking about it to kabuto when he summoned it) is because it's written how to fuse the rinnegan with the susano'o
