it is still with the snake..kabuto used it against itachi and sasuke...the sword can elongate by the will of the caster...the sword of sasuke is different...it is not the sword of kusanagi....there is only one sword of kusanagi in narutoverse..that is with oro/snake/kabuto

orochimaru isnt sealed, in the manga it shows a snake leaving right after he "got sealed". you can tell because the manga actually focuses on the snake giving you a hint

it was burnt with amaterasu

the remaining oro dna was with kabuto.....so oro is still living with kabuto..

Oro was never sealed, itachi just thought he had but all he did was seal the Oro from sasuke. If he did, who is powering kabuto's body. How did kabuto get to summon snakes with out Oro? Oro can't die, he rules.

Anyway, the sword was BA and probably the best in the series, as the user could control it from a distance, stretch as long as he knows and suppose to be able to cut thru anything.

it cannot cut through anything coz when the third summoning technique enma came and transformed into a stick it was not cut by kusanagi....

No I didn't see three snakes get away the only one I seen got burnt by Amaterasu
