Even if Tobi is manipulating Sasuke, that doesn't excuse him from the several crimes he's committed. Threatening a village, attacking and killing several samurai, attacking the Kage and killing one, and attacking Mifune, makes him a criminal.

Clearly, you seem to be a Sasuke devotee, no problem with that, but he is a criminal nonetheless. He has committed crimes whether they were influenced by others or not. As well as his intention to annihilate an entire village, where not everyone is guilty or connected to the fate of his clan and family tragedy. I think that would make him a criminal.
