I say Tobi. He can use his intangibility + teleporting to avoid Shinra Tensei and get near enough to warp away the Deva path. After that, its pretty much over.

And theoretically, Tobi can just warp over to Nagato and kill him

Nice theory but fail. There is no way Regular tobi with his Sharingan can able to defeat Pein. He can not defeat even Minato. Minato is fighting againt Kyuubi while that battle -.- It is not simple as warp over Anbu Rot members.
